USCIS Re-Bundles Adjudication of Forms I-129, I-539, and I-765 for Spouses and Minor Children of H-1B and L-1 Nonimmigrants

On January 20, 2023, USCIS permitted the resumption of bundling the adjudication of Form I-539 (Application To Extend/Change Nonimmigrant Status) and Form I-765 (Application for Employment Authorization) for the spouses and minor children of H-1B and L-1 nonimmigrants if they concurrently filed said forms with Form I-129 (Petition for a Nonimmigrant Worker).

Edakunni v. Mayorkas

The decision to bundle the adjudication of Forms I-539 and I-765 is in response to the settlement stipulated under the class suit Edakunni v. Mayorkas. In this case, the plaintiff claimed that the USCIS committed delays in processing the change or extension of their visa status and for work authorization. The bundling of applications should help improve hasten the processing periods.

Period of Validity

The bundling of applications shall begin on January 25, 2023, and will last for the next two years. This implementation covers regular and premium processing.
