3rd Phase of Premium Processing for EB-1 and EB-2 Form I-140 Petitions Is Underway

The United States Citizenship and Immigration Services (USCIS) is executing the third phase of the premium processing expansion for eligible EB-1 and EB-2 applicants with pending Form I-140, Immigrant Petition for Alien Workers (Form I-140) submissions. This phase specifically applies to those who filed Form I-140 petitions under an E13 (multinational executives and managers) or E21 (professionals with advanced degrees or exceptional ability) classification.

Previous Phases

During the first and second phases, the USCIS started accepting premium processing requests for E13 and E21 applicants with pending Form I-140 petitions who filed at an earlier date.

Third Phase

Since September 15, 2022, the USCIS started accepting Form I-907 requests from:

  • E13 petitions received on or before January 1, 2022; and
  • E21 petitions received on or before February 1, 2022.

The USCIS is strict with the abovementioned dates. Applications with a later receipt dates will be rejected. The agency has forty-five (45) days to take adjudicative action on premium processing requests. Further, the USCIS is currently not accepting new (initial) premium processing requests.
