DHS Starts to implement guidelines for the Enforcement of civil immigration law

Secretary of Homeland Security Alejandro N. Mayorkas signed the Guidelines for the Enforcement of Civil Immigration Law on September 30, 2021.

Just and Humane Procedures

During the implementation of the guidelines, Secretary Mayorkas released a statement discussing the importance of empowering the DHS to exercise its prosecutorial discretion in eliminating elements that pose threats to the country’s national security, public safety, and border security. In doing so, Secretary Mayorkas promised that his agency would fulfill its mission while being just and humane to everyone. He declared that in making enforcement decisions, he and the rest of DHS recognize that a massive population of undocumented noncitizens have positive contributions to United States’ growth and stability. They will not prioritize removing those citizens who do not pose serious threats to the country’s well-being.

Extensive Efforts and Training

Officers will ensure that every noncitizen will have access to a fair and equitable case review process. DHS will provide a thorough and case-by-case assessment to determine the legality and appropriateness of an enforcement action. Also, officers will undergo web-based and in-person training to master the guidelines. DHS aims for a consistent and standardized application of the guidelines nationwide.
