Some conditional permanent green cards have only a two-year validity. Immigrants should file a petition to remove the attached conditions within 90 days before their green cards’ expiry. Applicants who do not apply will lose their permanent resident status and be subject to removal.
Extended Validity of Green Card
USCIS extended the validity of some green cards by 48 months following their expiration dates. This announcement applies to immigrants who filed either of the following:
- Petition to Remove Conditions on Residence (for applicants who acquired their immigration status through marriage)
- Petition by Investor to Remove Conditions on Permanent Resident Status
The updated Form I-751 and Form I-829 receipt notices indicate that the extension also automatically applies to new applicants who filed the above-named petitions.
Implications of Green Card Extension
By presenting the receipt notices of the properly filed Form I-751 or Form I-829, alongside their expired green cards, immigrants can prove their continued legal immigrant status in the US. In effect, they still possess the authority to reside, work, and travel within the country for another 48 months following their conditional green card’s expiration date.
