Conditional Permanent Residents with Pending Form I-751 or Form I-829 Receives Extension for Green Card Validity

The number of petitioners for Form I-751 (Petition to Remove Condition on Residence) and Form I-829 (Petition by Investor to Remove Conditions on Permanent Resident Status) drastically increased in recent years. Due to the massive influx, the USCIS needs more time to process all eligible petitions. Unfortunately, the delay in the USCIS’s processing time may make some applicants anxious about their immigrant status while they wait.

A Necessary Solution

To solve this problem, USCIS extended the validity of green card statuses for those with pending Form I-751 and I-829 petitions starting January 23, 2023. Due to this change, applicants under both categories can lawfully stay within the United States for 48 months beyond the expiration of their green card while they wait for a decision on their applications. This issuance should remedy instances when applicants could not remove their conditional status on time due to processing delays beyond their control.

Changes in Receipt Notices

The USCIS is also updating the receipt notices of Forms I-751 and I-829 to reflect the new 48-month rule.
