Final Phase of EB-1 & EB-2 Premium Processing Expansion Is Underway

Many people are unaware that the USCIS offers premium processing services for specific applications. If you pay an additional amount, the USCIS will adjudicate your petition within a shorter period. For example, the expected processing time under premium processing is around 15 days compared to the regular processing time, which could take a few months.

On January 12, 2023, the USCIS implemented a premium processing expansion for EB-1 and EB-2 visas.

Covered Petitions

In comparison to other phases, the implementation of this phase’s expansion covers initial petitions and those with previous applications under the E13 and E21 categories. Specifically, these petitions refer to applications for multinational executive and manager positions and the National Interest Waiver (NIW).

Purpose of Expansion

According to the USCIS, the purpose of the expansion is to increase overall systematic performance and immediately process backlogs. In the following months, the agency will expand its premium processing services to more individuals. Please take note of the following:

  • March 2022: pending F1 applications for Optional Practical Training (OPT) and STEM OPT
  • April 2022: initial F1 students applications for Optional Practical Training (OPT) and STEM OPT
