When Is a Paper-Based Submission Considered Filed on Time?

USCIS is strict with submission deadlines. An applicant’s non-compliance may lead to their petitions’ denial. To avoid this situation, it is advisable for applicants to apply as early as possible. If they could not apply ahead of time, it will be crucial to know when is the last possible date of submission.

USCIS assigns a fixed deadline for every submission. However, a special rule applies if that deadline falls on a Saturday, Sunday, or federal holiday.

Guideline Clarifications

USCIS does not operate on a Saturday, Sunday, or federal holiday. Their offices are closed on these days and will not accept paper-based submissions. If the last submission or response date of a paper-based application or petition falls into either of those days, the due date will reset to the next business day. For example, if the submission date falls on a Saturday or Sunday, it will be reset on the next working Monday. Compared to paper-based submissions, electronically-submitted documents are deemed received immediately upon submission date.
